What is labor certification?

Labor certification is a common first step toward obtaining a green card. Foreign nationals who are potentially interested in permanent residence will often begin with the labor certification process.

Labor certification ensures that there has been unsuccessful recruitment in the domestic labor market prior to petitioning for an immigrant worker, with no qualified US workers willing to accept a particular position. Labor certification is closely linked with the Department of Labor, which fosters rigorous requirements for labor certification applicants.

A series of conditions must be met, including proof of the job prospect’s legitimacy, the financially sound status of a company, and the ability to pay both at the period of filing and throughout the green card process. These are just a few of the necessities of labor certification.

What is PERM ?

The Program Electronic Review Management (more commonly known as PERM ) is the filing system that became effective May 28, 2005. This is the newest application system, following the Reduction in Recruitment (RIR) filing procedure.

What is an I-140 Petition?

An I-140 petition is an Immigrant Worker Petition. In most categories, the labor certification must already have been approved prior to the filing of the I-140. The I-140 petition can be filed in simultaneity with the I-485 Adjustment of Status petition, which is a procedure that facilitates the lawful permanent residence of an applicant. The labor certification, PERM , I-140 and I-484 petitions are a series of components involved in the green card procedure.
