HIV positive parent denied Adjustment of Status; case was appealed and the parent received her Green Card.
A US Citizen Petitioner filed an Adjustment of Status Application on behalf of his elderly mother, who has been diagnosed as HIV positive. Due to her medical condition, she faced a few obstacles in obtaining permanent residency. However, with the help of the Gehi & Associates, P.C., the client was guided into the right direction in order to get her green card. USCIS requested to file an I-601 Waiver to overcome the grounds of excludability based on her medical condition. The initial waiver was erroneously denied by the USCIS. Our firm then proceeded to appeal this decision and the same has been granted by the USCIS.
